HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 6252 OF 2000 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This writ petition under Article 226 of the Constitution of India seeks the following relief:

"For the reasons sated in the affidavit accompanying this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus directing the respondents to effect the recovery of taxes from their respective departments in terms as notified by the Comptroller and Auditor General of India for the year ending 31.03.1998 in Book No.1 and Book No.2 placed before the State Legislature on 26.02.1999 and on 11.03.1999 respectively and pass such other order or orders as it may deem fit and proper in the circumstances of the case." Sri A. Satya Prasad, learned senior counsel appearing for the petitioner, submits that the petitioner would be satisfied if this petition is disposed of with the direction to the State Government to take appropriate steps for recovery of taxes from their respective departments in terms as notified by the Comptroller and Auditor General of India.

Having considered the prayer in the writ petition and the annexures thereto and so also the counter affidavit filed by the State Government, we dispose of this writ petition with the observation that the State Government may take appropriate steps for recovery of the arrears of taxes, if any, strictly in accordance with law.

Miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
