THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.12612 OF 2011 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the proceedings of respondent No.1 vide F2/1874/2009-1, dated 20.12.2010, and consequential notification issued by respondent No.2 vide Rc.No.E/3429/2008, dated 15.4.2011, as illegal, arbitrary and contrary to G.O.Ms.No.35 Consumer Affairs Food & Civil Supplies (CS-1) Department, dated 17.9.2007, and consequently, set aside the same.

Heard and perused the material available on record. 3.

Taking into consideration the subsequent developments and bifurcation of the districts in the state of Telangana and also the changes in the mandals, the proceedings of respondent No.1 vide F2/1874/2009-1, dated 20.12.2010, and consequential notification issued by respondent No.2 vide Rc.No.E/3429/2008, dated 15.4.2011, are set aside and respondent No.2 is directed to issue a fresh notification and proceed with the appointment of Fair Price Shop Dealers.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
