THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2513 of 2015 ORDER:

The grievance of the petitioners is limited to the extent that as against the orders in Roc.A/187/2014 dated 30.09.2014 passed by the respondent No.4, the petitioners filed an appeal before the respondent No.3/Revenue Divisional Officer, Madanapali Revenue Division, Madanapalli Mandal, Chittoor District along with an application seeking stay of the orders of the primary authority/respondent No.4. Without passing orders in the stay application, the respondents are interfering with the peaceful possession and enjoyment of the agricultural property, which is under cultivation by the petitioners.

Considering the limited relief, which is claimed, I deem it appropriate to dispose of the Writ Petition with a direction to the respondent No.3 to pass orders in the stay application, filed along with the appeal against the orders in Roc.A/187/2014 dated 30.09.2014 passed by the respondent No.4, within a period of eight (08) weeks from today. Pending consideration of passing of orders in the appeal, the petitioners' possession and enjoyment over the schedule property shall not be disturbed.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. --------------------------------------------- - CHALLA KODANDA RAM, J Dated: 09.02.2015 MVA
