THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER C.M.P.No.311 of 2017 ORDER:

This petition is filed under Section 24 CPC seeking to withdraw the suit O.S.No.4 of 2016 on the file of the Court of III Additional District Judge, at Kakinada, East Godavari District, and transfer the same to the Court of VII Additional District and Sessions Judge, Visakhapatnam, to try along with O.S.No.794 of 2015.

At the time of hearing, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the petition with a liberty to file a memo before the concerned court for clubbing of O.S.Nos.4 of 2016 and 5 of 2016. Permission is granted.

Accordingly, transfer C.M.P. is dismissed as withdrawn granting liberty to the petitioner to file a memo before the concerned court for clubbing of O.S.Nos.4 of 2016 and 5 of 2016. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
