The petitioner is A.1 among two accused in Crime No.07/RCOCIU-ACB/2018 for the offence punishable under Section 13 (1) (d) read with 13 (2) of the Prevention of Corruption Act, 1988 (for short, 'the Act').

Heard learned counsel for the petitioner/A.1 and learned Special Public Prosecutor for ACB appearing for the respondent. 3.

Perused the FIR and remand report.

The petitioner/A.1 is in judicial custody since 07.06.2018 in this case from the crime registered on 06.06.2018. Leaving about the earlier three cases registered under the provisions of the Act and he was granted either regular or default bail as the cases may be, including the last crime one day before his arrest and registration of the present crime, the submission of learned Senior Counsel, representing learned counsel for petitioner on record, is that the petitioner is falsely implicated in this case. The ACB officials are went upon to register one case or other to hook up by curtailing his personal liberty and even he came out of bail on the next day after his enlargement on bail in Crime No.3 of 2018 in Crl.M.P.No.5556 of 2018 vide order, dated 05.06.2018.

Learned Special Public Prosecutor for ACB opposed the bail application saying that in this case the role of several officials of H.M.D.A also under investigation and at that crucial stage if the petitioner is enlarged on bail, he may interfere with the investigation

process thereby he does not deserve concession of bail that to at this stage.

Though, earlier the petitioner was granted bail in all three crimes, so far as the present crime is concerned, from the above submission that the investigation is at crucial stage and there is likelihood of his interference in the process of investigation, the application is dismissed to renew from changed circumstances later. ______________________________ Dr. B.
