M/S. Paramount Agencies (P) Limited (In Liqn.) v. No Respondent

THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY APPLICATION No. 311 OF 2018 IN COMPANY PETITION No. 218 OF 2004 O R D E R :

This Company Application has been filed seeking the following reliefs:

i) dispense with the publication of notice in Form No. 63 in newspapers for inviting the claims from the creditors of the company in liquidation;

ii) permit the Official Liquidator to issue notices to the creditors as per the Statement of Affairs of the company, as per Rule 148(2) of the Companies (Court) Rules, 1959;

iii) dispense with the issuance of notices to the creditors as per Rule 148(2) of the Companies (Court) Rules, 1959;

iv) permit the Official Liquidator to exercise all the powers required for adjudication of claims.

Considering the amounts available as on date and also considering the fact that there were only two claimants, this Court is of the view that publication of advertisement would add additional expenditure. In those circumstances, publication of notice in Form No. 63 in newspapers is dispensed with. Insofar as the other reliefs are concerned, the Official Liquidator is permitted.
