THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12081 OF 2017 ORDER:

This writ petition is filed seeking a direction to the respondents 2 and 3 for providing necessary aid to the petitioner for the purpose of smooth and lawful performance of the Kalyanam of the Lord Sri Rama on the eve of Sriramanavami, on 05.04.2017 at Munnuru Kapu Bhavan, Kachiguda, Hyderabad, pursuant to the representation of the petitioner, dated 01.04.2017. Learned Government Pleader, on the basis of the written instructions, submits that the place where the Kalyanam is sought to be conducted is owned by the Munnuru Kapu (Kapu) Vidyarthi Vasathi Gruham Trust Board (for short 'Trust Board'). The Trust Board addressed a letter on 27.03.2017 categorically stating that they are not allotting the hall to any party to celebrate Sriramanavami festival.

It is also stated that the building itself is under the control of the Special Executive Magistrate in crime No.150 of 2016 registered under Section 107 of the Code of Criminal Procedure. In spite of the said letter, it appears that the petitioner requested the Trust Board to grant permission. In view of the circumstances, if permission is granted by the Trust Board to the petitioner, it is open to the petitioner to approach the concerned authority, the second respondent, seeking necessary protection for performing Lord Sri Rama Kalyanam and on receipt of the said representation along with permission of the Trust Board, the second respondent shall consider the same and pass appropriate orders in accordance with law.

The writ petition is accordingly disposed of. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
