THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION Nos.5991 & 5993 OF 2018 COMMON ORDER:
These two criminal petitions are filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') to quash the proceedings in Crl.M.P.No.278 of 2018 in S.T.C.No.84 of 2015 (Old C.C.No.241 of 2015) and in Crl.M.P.No.279 of 2018 in S.T.C.No.26 of 2016 (old C.C.No.244 of 2015), whereby the petitions filed under Section 70(2) Cr.P.C. for recall of N.B.W. issued against the petitioner was dismissed.
It is the case of the petitioner that he was undergoing treatment in Morning Star Hospital due to injuries sustained by him in the road accident thereby he was prevented by sufficient cause.
The petitioner was absent when the petition was taken up for hearing. Hence, the trial court dismissed the petition. However, the petitioner is permitted to appear before the Court and to file an application under Section 70(2) Cr.P.C., after serving notice on the respondent, and in the event of filing any application, the trial court is directed to dispose of the same on the same day. With the above direction, these criminal petitions are disposed of.
Miscellaneous petitions, if any, pending in these criminal petitions shall stand closed.
