THE HON'BLE SRI JUSTICE G. CHANDRAIAH AND THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO F.C.A. No. 323 of 2012 ORDER: (per Hon'ble Sri Justice G. Chandraiah) This Family Court Appeal, under Section 19 of the Family Courts Act, 1984, is filed by the appellant-husband questioning the judgment and decree in O.P.No.4 of 2008, dated 19.10.2012, on the file of the Family Court-cum-IV Additional District Judge, Vijayawada, Krishna District. The said O.P. was filed by the respondent-wife, under Section 13(1)(ia) of the Hindu Marriage Act, 1955, seeking dissolution of marriage, and the same came to be allowed by the impugned orders.

2. When the matter came up on 16.11.2012, this Court, while admitting the appeal, granted interim suspension of the impugned orders.

3. Learned counsel for the appellant addressed a letter to the Registry requesting to post the appeal under the caption of withdrawal.

4. Today, when the matter is listed under the caption of "For Withdrawal', learned counsel for the appellant reiterated his request and seeks permission of the Court to withdraw the appeal.

5. Permission is accorded.

6. Accordingly, the appeal is dismissed as withdrawn. No costs. Miscellaneous petitions, if any pending, shall stand closed.
