CVNR,J & GSP,J W.P.No.19317 of 2018 ORDER : (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for issue of Habeas Corpus by declaring the action of respondent No.3 in detaining the detenu, by name Mohammed Younus, s/o. Mohammed Yousuf (for brevity "the alleged detenu") as illegal and arbitrary, and consequently to direct the respondents to forthwith produce the alleged detenu before the Court and set him free.
At the hearing, the learned Assistant Government Pleader for Home representing the learned Advocate General (T.S.), on instructions, submitted that as the alleged detenu is an Accused in Crime No.178/2018 of Abdullapur Police Station, registered for the offences punishable under Sections 302, 364 and 120-B IPC r/w. Section 34 IPC, he was arrested by respondent No.3 police and produced before the VII Metropolitan Magistrate, Hayathnagar, Ranga Reddy District, who inturn remanded him to the judicial custody.
In the light of this submission, the cause in the writ petition does not survive for adjudication and the writ petition is accordingly disposed of as infructuous.
