Petitioner complains against seizing tractor bearing No.AP 22 E 6159 as illegal and unconstitutional and seeks release of the vehicle in terms of G.O.Ms.No.3 Industries & Commerce (Mines-I) Department dated 08.01.2015 and G.O.Ms.No.15 Industries and Commerce (Mines-I) Department dated 19.02.2015.

On instructions, the Assistant Government Pleader for Home, submits that in Cr.No.216 of 2016 the subject vehicle has been deposited before the Court of Judicial First Class Magistrate, Vikarabad. Since the vehicle is deposited with the Court of competent jurisdiction, the petitioner has to move the Court for appropriate reliefs.

By granting liberty to file application for release of vehicles the writ petition is disposed of. Since policy decision is taken in G.O.Ms.No.3 dated 08.01.2015 and G.O.Ms.No.15 dated 19.02.2015 for release of vehicles, the petitioner is given liberty to bring the same to the notice of the Court when his application is considered for release of vehicle.
