A. Buchaiah, v. The Apsrtc, Rep. By Its Managing Director,
Date: 24.09.2018 Between:
A.Buchaiah, s/o. Shambhu Naidu, Aged about 35 years, Occu: Unemployee, r/o. tamaracheruvu Veedhi, Chodavaram, Visakhapatnam district.
.....Petitioner and The APSRTC, rep.by its Managing Director, Musheerabad, Hyderabad and another.
.....Respondents The Court made the following:
ORDER:
Petitioner was selected as Driver in Visakhapatnam Region of respondent-Corporation in the selections conducted between 04.02.2008 and 21.02.2008. After completion of medical examination and training, he was called on 27.09.2008 for issuance of posting orders. In the counselling conducted on 27.09.2008, he was posted to Anakapalle Depot. Petitioner did not join in the place of posting. Four years later, he submitted representation saying that due to personal reasons, he could not report duty and requested to provide employment. Said request of petitioner was rejected by order dated 04.07.2012. Aggrieved thereby, this writ petition is filed. 2.
A bare reading of the order impugned, as per the Rules governing appointments in Driver category, the panel drawn up by the respondent Corporation is valid for a period of 18 months only. The validity of 2008 Drivers selection panel was exhausted and fresh recruitment was conducted in the years 2009 and 2010 and those panels were also exhausted. In view of the same, request of petitioner was not acceded to.
3.
Admittedly, selections were made in the year 2008 and petitioner did not report duty in the place of posting and four years later, request was made to provide employment. I do not see any error in the decision rejecting the request of petitioner warranting interference at this stage. Writ Petition is accordingly dismissed. Pending miscellaneous petitions shall stand closed. ___________________________ JUSTICE P.NAVEEN RAO Date: 24.09.2018 kkm
