THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8040 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/Accused Nos.1 and 3 seeking bail in the event of their arrest in connection with Crime No.106 of 2023 on the file of Mellacheruvu Police Station, Suryapet District, registered for the offences punishable under Sections 341, 307 and 427 r/w.109 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioners' family and the de-facto complainant's family and others were fighting over a road which was passing by the side of the land of these petitioners to the land of the de-facto complainant. The said road was called as Somaraju Donka. However, these petitioners alleged ploughed the road in the night resulting altercation between the de-facto complainant's group and petitioners' group. As seen from the record, both the parties have received injuries. The 2nd petitioner filed a complaint registered as Crime No.105 of 2023. The de-facto complainant also filed a complaint which is
registered as Crime No.106 of 2023 against these petitioners. Both the petitions are pending investigation before Mellacheruvu Police Station, Suryapet.

Keeping in view that there was a free fight between both the groups and case and counter cases were also filed, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioners, subject to the following conditions:
1) The petitioners/Accused No.1 and 3 are directed to surrender before the Station House Officer, Mellacheruvu Police Station, Suryapet District, on 01.09.2023. On such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 and 3 on bail, on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the 1st petitioner/Accused No.1 shall appear before the concerned Station House Officer at 10.00 A.M for a period of eight weeks for the purpose of investigation and thereafter, as and when required. The 2nd petitioner/A-3 shall appear before the Police as and when required.
3) The petitioners/Accused Nos.1 and 3 shall abide by the other conditions stipulated in Section 438(2) of
Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
