HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1999 of 2017 O R D E R :

The contempt case is filed alleging violation of the order dated 06.04.2017 passed by this Court in WP.No.11889 of 2017, wherein this Court directed the 4th respondent to dispose of the application filed by the petitioner in Form VI-A after issuing notice to him within a period of eight weeks from the date of receipt of a copy of the order.

The respondent filed counter stating that in pursuance to the orders of this Court in the aforesaid writ petition an enquiry was conducted to know the eligibility of the petitioner to issue pattadar pass book for the subject land i.e.Ac.2.50 cents in R.S.No.575/1 of Ilaparru Village; and that in the enquiry since it was found that the petitioner was in possession of only 0.98 cents, Endorsement dated 09.06.2017 was issued wherein the 4th respondent while rejecting the application of the petitioner directed the petitioner to make another application for mutation to the extent of Ac.0.98 cents only. Learned Assistant Government Pleader for Revenue also produced copy of the Endorsement dated 09.06.2017 before this Court.

Learned counsel for the petitioner disputes the receipt of Endorsement dated 09.06.2017, said to have been passed by the respondent.

A perusal of Endorsement dated 09.06.2017 shows that it is received by the petitioner on 26.06.2017. When the respondent found in the enquiry that petitioner is in possession of only 0.98

cents, they could have considered the application of the petitioner to that extent only. In view of the same, the respondent is directed to consider the application of the petitioner for grant of Pattadar Pass Book in respect of Ac.0.98 cents only. However, it is open for the petitioner to challenge the Endorsement dated 09.06.2017, in accordance with law.

Accordingly, the Contempt Case is disposed of. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the Contempt Case, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 19.01.2018 t k.
