THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3930 OF 2009 ORDER:
This writ petition is filed questioning the G.O.Ms.No.11, Women Development, Child Welfare & Disabled Welfare (WP) Department, dated 18.02.2009, which was issued according permission to allow the minimum time scale (Basic Pay and D.A) to the posts attached to employees working in the 2nd respondentCorporation. Learned counsel for the petitioners submits that though the petitioners are working as permanent employees of the 2nd respondent Corporation, their pay scales were limited to minimum time scale without granting other allowances. He also submits that now the Government has issued G.O.Ms.No.44, Women Development, Chile Welfare & Disabled Welfare (WP) Department, dated 18.08.2010 wherein the permanent employees of the 2nd respondent were excluded from the purview of the G.O.Ms.11, dated 18.02.
2009 with effect from the issuance of the said G.O., but still the petitioners are being paid in terms of G.O.Ms.11 and that in the counter affidavit the respondents admitted that the petitioners are permanent employees and the 2nd respondent sent proposals to the Government vide letter No.1081/WCFC/A1/2008, dated 21.02.2009 for allowing scales with other perquisites by way of an amendment to G.O.Ms.No.
dated 18.02.2009 which is under consideration of the Government.
On the other hand learned Government Pleader for Women and Child Welfare Department (Telangana) submits that except petitioners 2, 5, 6 and 10 the other petitioners are not working in the state of Telangana. He also submits that the Managing Director of Telangana State Women Co-op., Development Corporation, Hyderabad has already written to the Government about the same vide letters dated 27.08.2015 and 25.05.2016. Since a reading of the G.O.Ms.No.44, Women Development Child Welfare & Disabled Welfare (WP) Department, dated 18.08.2010 goes to show that the permanent employees of the 2nd respondent Corporation are excluded from the purview of G.O.Ms.No.11, dated 18.02.2009 and since it is stated that the Managing Director of Telangana State Women Co-op.
Development Corporation has sent proposals to the Secretary to Government, WCD&SCs Department requesting to sanction HRA, CCA and Annual Grade Increment to the employees of minimum time scales, it is open for the petitioners to make appropriate application to the 1st respondent. Since it is stated by the learned counsel for the petitioners that some of the petitioners have retired from service, those petitioners are also shall make representation to the 1st respondent.
representations of the petitioners who are working and retired and also proposals sent by the Managing Director, dated 27.08.2015 and 25.05.2016, and take action in terms of G.O.Ms.No.44, dated 18.08.2010, within a period of three months from the date of receipt of a copy of this order. Till then interim order granted on 26.02.2009 shall continue.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
