THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.11666 of 2017 ORDER:

Heard the learned Counsel for the petitioners and the learned Government Pleader.

This Writ Petition is filed challenging the action of the second respondent in issuing a notice to attend to his office pursuant to registration of Crime No.209 of 2016 under Section 107 of Cr.P.C., when the parties shown in Group - B were also appearing on the same day.

Learned Counsel for the petitioners submits that by virtue of presence of both the groups of people on the same day, there is a threat to life and law and order problem. He further submits that a Memo was filed before the second respondent on 25.03.2017. He submits that, in the said memo the petitioners stated that there will be threat to their life if they are asked to appear on the same day when the other group of people, who are involved in the same offence, are also asked to appear, and sought for giving a separate date.

The aforesaid memo was filed on 25.03.2017 and without waiting for any order, the petitioners approached this Court. Since the matter is before the second respondent, this Court is not inclined to entertain the present Writ Petition, but directs the second respondent to consider the said memo or issue necessary instructions to the concerned Police to give protection

to the petitioners for their appearance on the specified date, if there is a real threat to their life.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ A.RAMALINGESWARA RAO, J 03.04.2017 vs
