THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8044 OF 2023 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking to relax the conditions imposed by the Special Judge for Economic Offences, Hyderabad in HQ.POR.No.169 of 2023, by reducing the surety amount from Rs.2,00,000/- to Rs.25,000/- each with one surety. 2.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.
The petitioner was released on bail by the learned Special Court for Economic Offences on 15.08.2023 on the condition that he shall execute personal bond for Rs.2,00,000/- with two sureties for the like sum. 4.
Learned counsel for the petitioner would submit that the petitioner had nothing to do with the gold. He
was courier of the said gold and without knowledge he had brought the gold.

Learned counsel appearing for the respondent objected for reduction of surety.

As seen from the record, he was granted bail on 15.08.2023. Having failed to furnish security as directed, he is still in jail.

Keeping in view that he was already granted bail, this Court deems it appropriate to reduce quantum of surety. The petitioner shall be released on bail on furnishing personal bond for Rs.50,000/- with two sureties for the like sum.

Accordingly, the order dated 15.08.2023 passed by the learned Special Judge for Economic Offences is modified. Miscellaneous Petitions, pending if any, shall stand closed _________________ K.SURENDER, J Date: 23.08.2023 dv
