HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19385 OF 2018 O R D E R :

This writ petition is filed challenging the order dated 21.11.2017 passed by the 4th respondent directing the 6th respondent to open rowdy sheet against the petitioner. The case of the petitioner is that the 4th respondent passed order dated 21.11.2017 directing the 6th respondent to open rowdy sheet against him on the ground that he is involved as an accused in Crime No.2/2016 under Sections 341, 324 r/w.34 IPC and Cr.No.19/2015, under Section 107 Cr.P.C of Chapadu P.S. to keep close watch on his movements.

Learned counsel for the petitioner submits that in Crime No.2/2016 on the file of Chapadu P.S, the petitioner was acquitted as the case was compromised and in another crime i.e. Crime No.19/2015 on the file of Chapadu Police Station, Sec.107 CRPC proceedings were initiated for a period of six months and the same was closed long back. He further submits that the competent authority in a mechanical fashion and even without application of mind has opened rowdy sheet against the petitioner. He also relied on the Judgment of this Court in K.Suresh babu v. Superintendent of Police, Anantapur District 1.

Heard learned Assistant Government Pleader for Home. Since already representation of the petitioner is pending, the competent authority is directed to dispose of the said representation in terms of the aforesaid Judgment relied on by the petitioner in K.Suresh Babu's case and also the Judgment rendered by this Court in WP.No.45130 of 2017, dated 2.01.2018. No order as to costs.
