The Hon'ble Sri Justice J.Sreenivas Rao Criminal Petition No.9206 of 2025 Order:

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarika Suraksha Sanhita, 2023 (for short, 'BNSS') seeking anticipatory bail to the petitioner/accused No.4 in Crime No.58 of 2025 of Sadasivpet Police Station, Sangareddy District, registered for the offences punishable under Sections 331(4), 305, 317(2) and 61(1) of Bharatiya Nyaya Sanhitha, 2023 (for short 'BNS').

The case of prosecution in brief is that on 09.02.2025 at about 14:00 hours, the complainant lodged a complaint, stating that he is working as HR Senior Manager in Arene Life Sciences (Unit-3) Private Limited, Yavapur Village, Sadasivpet, and on 08.02.2025 at about 17:35 hours, their company received material of 10% palladium Carbon from Hindustan Platinum Private Limited, Navi Mumbai through Blue dart courier vehicle and accused No.9 and other warehouse members unloaded the material, kept the same in PD carbon room of warehouse, locked the PD carbon room and left to

their houses but on 09.02.2025, the Deputy Manager of warehouse department observed that some material is missing and some unknown offenders had committed theft of the material from PD carbon room. Basing on the said complaint, the present crime is registered against the petitioner/accused No.4 and other accused for the aforesaid offences. 3.

Heard Mr. P.Sriharinath, learned counsel for the petitioner/accused No.4 and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent/State. 4.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and he has been falsely implicated in this case. Learned counsel further submits that the alleged material was seized from the possession of accused No.1 only and hence, the ingredients of Section 331(4) and 317(2) of BNS are not attracted against the petitioner and all other offences levelled against him are punishable with imprisonment upto seven years only. He further submits that accused Nos.1 to 3, 7 and 9 to 12 in the aforesaid crime were already arrested and enlarged on bail and the entire

investigation is completed except filing of chargesheet and the petitioner is not having any criminal antecedents and he is ready and willing to cooperate with the investigation and abide by the conditions as may be imposed by this Court and prays for grant of anticipatory bail.

On the other hand, learned Additional Public Prosecutor submits that the petitioner has committed grave offence and specific allegations are levelled against him to attract the ingredients of Sections 331(4) and 317(2) of BNS and the investigation is under progress and at this stage, if the petitioner is granted anticipatory bail, there is every chance of his influencing the witnesses and interfering with the investigation and hence, he is not entitled for grant of anticipatory bail.

Having considered the rival submissions made by learned counsel for the respective parties and after perusal of the material available on record, it reveals that accused Nos.1 to 3 and 9 to 11 were arrested on 20.02.2025 and accused No.12 was arrested on 22.02.2025 and accused No.7 was arrested on

24.04.2025 and according to the learned counsel for the petitioner, they were enlarged on bail. Even according to the learned Additional Public prosecutor, except the present crime the petitioner has no criminal antecedents.

In view of the same, this Court is inclined to grant anticipatory bail to the petitioner/accused No.4, subject to the following conditions:

i. The petitioner/accused No.4 shall surrender before the Station House Officer, Sadasivpet Police Station, Sangareddy District, on or before 04.08.2025, and on such surrender, the said Station House Officer shall release the petitioner/accused No.4 on bail on his executing a personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each.

ii. On such release, the petitioner/accused No.4 shall appear before the Station House Officer, Sadasivpet Police Station, on every Monday at 11:00 a.m. for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. After release, the petitioner/accused No.4 shall not influence the witnesses or interfere with the investigation.

iv. Petitioner/accused No.4 shall abide by the conditions stipulated under Section 482(2) of BNSS and shall cooperate with the Investigating Officer in the investigation.

v. After release, if the petitioner/accused No.4 indulges in similar offence, the respondent/State is at liberty to file an application seeking cancellation of bail.

Accordingly, the Criminal Petition is allowed. As a sequel, miscellaneous petitions, pending if any, stand closed.
