This petition is filed for a writ of Mandamus declaring the action of the respondents in seizing and detaining the Lorry No.AP 27 TU 2829 of the petitioner and keeping the said lorry in the respondents custody from 01.05.2017, and in not releasing the vehicle, as arbitrary and illegal.
Learned Counsel for the petitioner submits that in similar circumstances this Court disposed of WP.No.4895 of 2017 on 13.02.2017 and the same is not disputed by the learned Assistant Government Pleader for Mines and Geology. He further submits that the owner of the goods which the seized vehicle is carrying also filed WP.No.16944 of 2017 seeking release the said vehicle. Learned counsel for the petitioner in WP.No.16944/2017 states that they hired the petitioner's vehicle (Lorry No.AP 27 TU 2829) to carry the goods and that they have no objection for release the said vehicle in favour of the petitioner in WP.No.24869/2017. In view of the facts and circumstances and following the order dated 13.02.2017 passed by this Court in WP.No.4895 of 2017, the writ petition is disposed of directing the respondents to release the vehicle (Lorry No.AP 27 TU 2829) to the petitioner on production of ownership particulars by him. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
