THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.13649 of 2011 ORDER:

Heard Sri Mohd.Islamuddin Ansari for petitioner and Sri Md.Saleem for respondents 1 to 3.

Counsel for petitioner submits that against the endorsement impugned in the writ petition, the petitioner can avail remedy of appeal before the 3rd respondent-Kalyandurg Municipality and the petitioner may be given liberty to file an appeal before the 3rd respondent.

Learned Standing Counsel does not objec t to the request of petitioner.

The writ petition is disposed of by this order. The petitioner is given four weeks time from the date of receipt of a copy of this order to avail remedy of appeal before the 3rd respondent by enclosing a copy of this order.

The petitioner, if presents the appeal, as directed by this order, the 3rd respondent is directed to number the appeal and dispose of the same on merits without reference to the alleged delay, if any, in filing the appeal.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
