.I and Crl.P.No.6442 of 2017 COMMON ORDER The criminal petition is filed under Section 482 Cr.P.C., to quash the proceedings in C.C.No.368 of 2015 on the file of the I Additional Judicial First Class Magistrate, Huzurbad, Karimnagar District, registered for the offence under Section 138 of Negotiable Instruments Act, 1881 (for short 'the Act'), against the petitioner/accused. 2.

I.A.Nos.1 and 2 of 2019 are filed under Sections 320(2) and 320(6) Cr.P.C., by both parties seeking leave of this Court to compound the offence and to record compromise as the matter was settled out of the Court due to intervention of the elders and well-wishers. They stated that they intend to maintain good relationship with each other and there is no grievance between them and therefore, prayed to quash the proceedings against the petitioner/accused in the aforesaid case. 3.

Today, when the matter came up for hearing, the second respondent/de-facto complainant and the petitioner/accused are present and they are identified by their respective counsel. When this Court enquired the parties, the petitioner stated that he paid an amount of Rs.3,50,000/- to the 2nd respondent/de-facto complainant towards full and final settlement of all the claims and the de-facto complainant has acknowledged receipt of the said amount and he agreed to withdraw the present case against the petitioner/accused.

4. In view of the compromise arrived at between the parties, it would be appropriate to grant leave to the parties to compound the offence and to quash the proceedings against the petitioner/accused.

5. In the result, I.A.Nos.1 and 2 of 2019 is ordered. Consequently, the Criminal Petition is allowed and the proceedings in C.C.No.368 of 2015 on the file of the I Additional Judicial First Class Magistrate, Huzurabad, Karimnagar District, are hereby quashed against the petitioner/accused. However, the petitioner/accused is directed to deposit a sum of Rs.5,000/- (Rupees five thousand only) before the High Court Legal Services Committee, Hyderabad, within ten days from today.

6. Miscellaneous petitions, if any pending in the criminal petition, shall stand closed.
