THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.824 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-Accused under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in FIR No.274 of 2015 on the file of Sangareddy Town Police Station, Medak District, registered for the offence punishable under Sections 120-B, 418, 420, 464 r/w 34 IPC.

Heard and perused the material available on record. It is alleged that A1 to A7 representing that they are the owners of a land, induced the complainant to enter into developmental agreement with A1 to A3 and received three crores and A4 executed agreement of sale-cum-GPA in favour of the complainant and in the meanwhile, the complainant received a notice from One Venkateshwar Reddy, GPA holder of A5 to A7, in which it is stated that he filed a suit against A5 to A7 to cancel the sale deed executed by A5 to A7. It is alleged that all the accused conspired together and cheated the complainant.

When the matter is taken up for hearing, the learned Counsel for the petitioner submitted that co-accused approached this Court by way of invoking Section 482 Cr.P.C. wherein this Court passed orders directing the police to strictly adhere to the provisions of Section 41-A Cr.P.C. Hence, he prays this Court to dispose of the petitioner in the same terms.

Considering the above submission of the learned Counsel for the petitioner, the Criminal Petition is disposed of directing the respondent-police concerned to follow the procedure laid down in Section 41-A of Cr.P.C. prior to arrest of the petitioner herein.
