THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4712 of 2015 ORDER:
The case of the petitioner is that he is resident of Krishnapuram Village, Pachanapalle Post, Chittoor District. His neighbour by name R. Subramanyam Naidu, who had two bore wells existing, has dug a bore well within 19 metres of his bore well, only to cause damage to the petitioner, particularly, to damage to Ac.4-54 cents of Mango Garden. The digging of bore well is in contravention with the provisions of A.P. Water, Land and Trees Act, 2002 (for short 'the Act'). He has made complaints to the Mandal Revenue Officer and also to the District Collector. In spite of his complaints, which are dated 04.08.2014 and 23.09.2014, though the Collector had directed the MRO to take suitable action, even as on today, nothing has been done. Hence, this writ petition.
Considering the limited prayer of the petitioner that his complaint be considered and enquired into without entering into the merits of the matter, this writ petition could be disposed of directing the respondents to cast enquiry into the allegations of the petitioner and take necessary action in terms of the Act, within a period of six (6) weeks from today. It is needless to mention that digging of bore well is governed by the provisions of the Act and also the guidelines issued in G.O.Ms.No.227, dated 08.04.2013 of Panchayat Raj and Rural Development (RD.III) Department, after giving notice to all the parties concerned. No costs.
Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
