THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION NO.12019 OF 2016 ORDER:
The petitioners assail the action of the Station House Officer, Prohibition & Excise Police Station, Pattikonda, Kurnool District in not releasing the property i.e., 138 bags of jaggery each bag containing 50 kgs, 14 bags of Spatika Powder each bag containing 35 kgs and 5 bags of Spatika pieces seized in Crime No.176 of 2016-17 for interim custody. The petitioners/A1 to A3 allegedly committed the offences punishable under Section 34(e) of the A.P. Excise Act, 1968 and Clause 3 of GUR (Jaggery) Regular Order, 1968. Heard both sides and perused the record.
The Criminal Petition is disposed of giving liberty to the petitioners to file appropriate application before the Deputy Commissioner of Excise for release of the seized property upon which the Deputy Commissioner shall dispose of the said application within a period of one week from the date of receipt of such application positively.
Pending miscellaneous applications, if any, shall stand closed in consequence.
