HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12376 of 2003 ORDER :

Heard learned counsel for the parties.

When the matter is taken up for hearing, learned counsel for petitioner submitted that the petitioner has challenged the show cause notice dated 22.01.2003 for removal/dismissal and there were no stay orders by this Court. Be that as it may, the petitioner was continued under suspension and the petitioner was allowed to retire on 30.06.2004 while under suspension. The grievance of the petitioner is that though she was allowed to retire vide proceedings dated 30.06.2004, the terminal benefits of petitioner are not settled.

This Court, having considered the said submission of the learned counsel for petitioner, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a representation to the respondent-Corporation seeking terminal benefits, within two weeks from the date of receipt of a copy of this order. Upon such representation being received, the respondent shall consider the same and pass appropriate orders in accordance with law within four weeks thereafter. With the above observations, the writ petition is disposed of. No order as to costs.
