HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO MACMA.No.1140 of 2005 ORDER:

The appeal is preferred against the award of the Motor Accident Claims Tribunal-cum-I Additional District Judge, Kurnool, passed in MVOP.No.950 of 2003 by the 1st respondent-owner-cum-driver of the vehicle. The accident occurred on 06-03-2002 and the Tribunal awarded an amount of Rs.8,33,000/- to the claimants along with interest at 9% p.a. by the award dated 30-05-2005. Learned counsel for the appellant submits that immediately after filing the appeal, the appellant died on 22-12-2005 and the record of the Court does not reveal of taking any steps by the legal representatives for prosecuting the present appeal. In the circumstances, the appeal stood abated and the same is accordingly dismissed.
