THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.2192 of 2017 ORDER:

The present petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioner/accused No.1 requesting to grant permission to him to go to Dubai for business purpose. In the petition, it is stated that on earlier occasion i.e., on 20.07.2016, this Court, in Criminal Petition No.10226 of 2016, granted permission to the petitioner for leaving country abroad for a period of 17 days and now again the petitioner is required to go to Dubai for business purpose, for which he needs permission enabling the passport authorities to renew the passport, as visa will be granted when the passport is valid and before completion of six months period.

In Criminal Petition No.10226 of 2016, by order dated 20.07.2016, this Court granted permission to the petitioner for leaving the country abroad for a period of 17 days commencing from 21.07.2016 to 06.08.2016, with a direction that he shall return by 06.08.2016 and face trial before the Court below and, in that regard, he was also directed to file an undertaking affidavit before the concerned Magistrate before leaving the country. Learned counsel for the petitioner requests to grant permission to the petitioner for leaving country for a period of 15 days in the month of April, 2017 by fixing the dates.

Keeping in view, the earlier orders of this Court, the petitioner is granted permission to leave the country to go abroad for a period of 15 days commencing from 15.04.2017 to 30.04.2017 and, invariably, he shall return by 30.04.2017 and appear before the Court below. Further, the petitioner shall file an undertaking affidavit before the learned Magistrate before leaving the country. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending in the Criminal Petition shall stand closed.
