THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4263 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the inaction of the respondents in applications made to the respondents, dated 05-12-2004, 12-08-2008 and 07-02-2015 to reinstate the petitioner as surface coal filler in the organization of the 2nd respondent as illegal, arbitrary, unjust, unlawful, unconstitutional and against to the standing orders of the organization of the 2nd respondent and the provisions of the Industrial Dispute Act, 1947 and against to Articles 14, 15, 16, 19 and 21 of the Constitution of India and also against to the judgments of Apex Court."

Heard, Sri Chikkudu Prabhakar, learned counsel for the petitioner and Sri J. Srinivasa Rao, learned counsel for the respondents.

During the course of hearing, it is brought to the notice of this Court by learned counsel for the petitioner that for redressal of the grievance of the petitioner herein, the petitioner herein submitted representations, dated 05-12-2004, 12-08-2008 and 07-02-2015 and the same have not been disposed of so far by the respondents. It is also requested by learned counsel for the petitioner that the petitioner would make a fresh representation to the respondents and the same may be directed to be disposed of by the respondents, in accordance with law, by fixing some timeframe. The said request is not opposed by learned counsel for respondents and this Court considers the said

request as reasonable.

Recording the said submission and having regard to the nature of controversy, the writ petition is disposed of, without expressing any opinion on the merits of the matter and entitlement of the petitioner, keeping it open for the petitioner to submit fresh representation to the respondents for redressal of his grievance within a period of two (2) weeks from the date of receipt of a copy of this order and if any such representation is made same be considered and appropriate orders be passed by the respondents, in accordance with law, within a period of six (6) weeks from the date of submission of the said representation. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
