HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN ARBITRATION APPLICATION NO.94 OF 2015 ORDER:
Heard Sri Anand Kumar Kapoor, Learned Counsel for the petitioner and Sri Singam Srinivasa Rao, Learned Counsel for the respondent.
This application is made by the Registry on a letter being addressed by Justice K.C. Bhanu, retired judge, on 20.06.2016 stating that the parties were not evincing any interest to proceed with the arbitration case; and the entire bundle was being returned to be placed before this Court.
Sri Anand Kumar Kapoor, Learned Counsel for the petitioner, on instructions, undertakes that the petitioner shall henceforth prosecute the arbitration proceedings diligently. Learned Counsel would submit that the applicant has filed a claim statement before the learned arbitrator, albeit after he had returned the entire bundle. Sri Singam Srinivasa Rao, Learned Counsel for the respondent, submits that the respondents would also prosecute the matter before the arbitrator with due diligence.
In view of the submission now made by the Learned Counsel on either side, the entire papers shall be placed before Justice K.C. Bhanu with a request that he take up the arbitral proceedings, and pass an award at the earliest.
The application is disposed of accordingly.
