'HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.23933 OF 2006 ORDER:

Heard.

2. Alleging inaction on the part of the respondents in considering the representation of the petitioner dated 20.10.2006 the present writ petition is filed.

3. The case of the petitioner is that she availed loan of Rs.77,000/- from the second respondent and repaid the loan instalments upto 2005 and failed to pay thereafter. While so, the third respondent herein got an ex parte decree through the second respondent on 15.01.2001 vide Decree No.212/200001/GNT. Thereafter the first respondent issued Demand Notice vide E.P.No.60/2006-07/GNT dated 04.09.2006. After receiving the above said notice petitioner paid an amount of Rs.38,648/-. Even after payment of the said amount, the first respondent issued the notice of Sale of Immovable Property. Thereby, the petitioner submitted a representation on 20.10.2006 asking for some more time for payment of the amounts due.

In view of the facts and circumstances of the case, this Court deems it appropriate to dispose of the writ petition directing the second respondent to consider the representation of the petitioner and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
