ONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.743 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to direct the respondents to release pending Grant-in-Aid for the years 2002-03, 2003-04, 2004-05 and for DD II & AG Programmes for the year 2005-2006, and to revive all the programmes being conducted by the petitioner-organization as per the recommendations of the State Government.

It is stated in the affidavit that the petitioner-organization got sanction to run residential school and two old age homes and to conduct computer, typewriting, shorthand training for SC trainees and to conduct vocational training and rehabilitation programmes for disabled persons. For all these programmes, the Ministry of Social Justice and Empowerment issued sanctions and released 1st instalment for the year 2002-03. No amount was released to the Short Stay Home Programme. But sanctioned letter was given by the Central Social Welfare Board, New Delhi, during the year 1999-2000. While so, basing on the false report made by one K. Lokanadham, the Central Social Welfare Board cancelled Short Stay Home programme and blacklisted the petitioner-organization from further funding.

On the representation made by the petitioner, various committees inspected the petitioner-organization and sent a report to the Principal Secretary to Government for release of pending grant-in-aid and to de-blacklist the petitioner-organization. The State Government made specific recommendations through letter dated 18.2.2009 to release grantin-aid. But the respondent did not release the funds.

After arguing for some time, the learned Counsel for the petitioner submitted that the petitioner has made a representation and therefore, a direction may be given to the respondent-authorities to consider the said representation.

Considering the facts and circumstances of the case, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The respondent is directed to consider the representation of the petitioner and dispose of the same within one month from the date of receipt of a copy of this order." 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 6th January, 2017 Nn
