THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 30034 OF 2017 O R D E R:

The case of the petitioner is that recognition / affiliation granted in its favour was withdrawn vide proceedings dated 27.03.2008, alleging certain irregularities. Thereafter, a criminal case was also booked against the Correspondent of the petitioner college and two others for the offences punishable under Sections 420, 467, 468, 471, 474 read with Section 34 of the Indian Penal Code and they were tried in C.C. No. 1565 of 2010 on the file of the XVII Additional Chief Metropolitan Magistrate's Court at Nampally. Meanwhile, the petitioner filed Writ Petition No. 13630 of 2008 challenging the proceedings dated 27.03.2008 of the 2nd respondent Secretary, Board of Intermediate Education. The said Writ Petition was disposed of by the order dated 04.09.

2014 giving liberty to the petitioner to submit a representation to the 2nd respondent, after conclusion of the trial of the criminal case, pursuant to registration of Crime No. 37 of 2008 and the 2nd respondent should consider the same and pass appropriate orders. Now, inasmuch as the criminal case has ended up in acquittal on 21.04.2017, the representation dated 12.05.2017 has been submitted to the 2nd respondent to restore affiliation to the petitioner institution, yet, no orders have been passed. Hence, this Writ Petition.

Heard learned counsel for the petitioner as well as learned Government Pleader for Higher Education (Telangana). Since the petitioner has submitted the representation, pursuant to the order passed by this Court in Writ Petition No.

13630 of 2008 and since the interim relief is akin to the main prayer, the Writ Petition itself is disposed of directing the 2nd respondent to consider the representation of the petitioner dated 12.05.2017 and take necessary action thereon, within two weeks from the date of receipt of a copy of this order. It is made clear that if the petitioner is required to comply with any of the prescribed procedure for seeking affiliation, the same shall be attended to. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
