Heard learned counsel for the petitioners/A.1 to A.6 in crime No.129 of 2017 of Dharmasagar Police Station, Warangal District, registered for the offence under Sections 120-B, 290, 324, 506 r/w 34 IPC and also learned Public Prosecutor representing the State and before ordering notice to the 2nd respondent-defacto complainant.

A perusal of the FIR shows the investigation is at the nasal stage, for there is nothing to interdict the investigation. Having regard to the above, the Criminal Petition itself is disposed of without prejudice to all available defence of the accused persons, but for to say if all any arrest of the petitioners required strictly to follow Section 41-A Cr.P.C. and guidelines of the expression of the Apex Court in Arnesh Kumar Vs. State of Bihar1.
