HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7599 of 2017 ORDER:

Heard learned counsel for the petitioner/ accused of Crime No.335 of 2017 on the file of the Ibrahimpatnam Police Station, Rachakonda District, registered for the offence punishable under Sections 3(1)(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2015 (for short 'the Act') and learned Public Prosecutor representing the State before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition and the contents of the F.I.R. apart from there is a delay from the date of alleged occurrence on 24.06.2017 to the report registered by the police as crime on 06.07.2017. From the very face value of the averments, no offence is made out punishable under Sections 3(1)(i)(r) of the Act, since there is no public view.

Having regard to the above, the investigation shall go on. However, the petitioner/ accused shall not be arrested pending investigation. It is made clear that this will not prevent the police to secure the presence of the petitioner for the purpose of investigation, as and when required.
