THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6259 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A6 in Crime No.383 of 2022 on the file of Saroornagar Police Station, Rachakonda, Hyderabad, registered for the offences punishable under Sections 302, 380 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioner is Accused No.6 against whom the offence alleged is under Section 120 B of Indian Penal Code. 4.

The case of the prosecution is that Accused No.1 with the help of his friends killed his mother for gold ornaments and cash. Prior to killing A1's mother A1 had met other accused and planned to eliminate her. However, again, A2 who helped in killing the deceased was also eliminated by the

other accused with the fear that A2 would reveal the acts of committing murder.

As seen from the Remand Report, the petitioner/A6 was neither present when the mother of A1 was killed nor when A2 was killed.

In the said circumstances, as the petitioner is in jail since 13.05.2022 and even according to the prosecution, he was not present when both the murders took place, his bail application can be considered.

Accordingly, the Criminal is allowed and the petitioner/A6 is granted bail subject to the following conditions:

i) The petitioner/A6 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of XI Additional Metropolitan Sessions Judge at L.B.Nagar, Ranga Reddy District.

ii) The petitioner/A6, after release shall appear before the concerned Station House Officer every Monday between 10.30 AM and 01.00 PM for a period of three months or till filing of charge sheet whichever is earlier, for the purpose of investigation.

iii) The petitioner/A6 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
