HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35364 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking a direction to the 4th respondent to act upon the complaint dated 15.7.2016 and take action in accordance with law against respondents Nos.5 and 6.

Heard and perused the material available on record. 3.
Respondent No.5 is the elder son of the petitioner and 6th respondent is the wife of the 5th respondent. The main grievance of the petitioner is that respondents Nos.5 and 6 along with their henchmen entered into the portion of the petitioner and took away the valuables and cash forcibly and they are making threats to do away the lives of the petitioner and her other children. Therefore, the petitioner gave a written complaint on 15.7.2016 to the 3rd respondent and the 3rd respondent vide his endorsement directed the 4th respondent to take action. But the 4th respondent did not take any action so far.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
"Respondent No.4 is directed to register the complaint of the petitioner dated 15.7.2016, if it discloses any cognizable offence and proceed in accordance with law. If the 4th respondent fails to register the complaint, the petitioner is at liberty to avail the remedies that are available under Cr.P.C."
There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
