With the consent of both the parties, the main writ petition is disposed of at the admission stage.
Heard learned counsel for the petitioner and Government Pleader for Revenue.
The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the action of the respondents in trying to dispossess the petitioner from the dry land admeasuring Ac.5.12 gts., situated in Sy.Nos.719/5, 719/6, 719/7, 719/8, 719/9 and 720/1 of Nagulavaram Village, H/o. Bogole, Bogole Mandal, SPSR Nellore District, without following due process of law, as illegal, arbitrary, unjust and without jurisdiction; and consequently direct the respondents not to dispossess the petitioner from the said land. It is represented by the learned counsel for the petitioner that the petitioner is in possession of the dry land admeasuring Ac.5.12 gts., situated in Sy.Nos.719/5, 719/6, 719/7, 719/8, 719/9 and 720/1 of Nagulavaram Village, H/o. Bogole, Bogole Mandal, SPSR Nellore District and without following due process of law, the respondents are trying to interfere with the agricultural operations going on in the said land.
No counter is filed on behalf of the respondents. Having regard to the circumstances of the case and without going into the merits of the case, the respondents are directed not to dispossess the petitioner or interfere with the agricultural operations, if any, going on in the land admeasuring Ac.5.12 gts., situated in
Sy.Nos.719/5, 719/6, 719/7, 719/8, 719/9 and 720/1 of Nagulavaram Village, H/o. Bogole, Bogole Mandal, SPSR Nellore District, without following due process of law.
With the above direction, the writ petition is disposed of. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
