The present writ petition is filed questioning the inaction of the third respondent in registering the FIR pursuant to the complaints lodged by the petitioner on 20.05.2019.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 28.10.2019, would submit that on receipt of the complaint/petition sent by the petitioner through registered post, an enquiry was conducted into the said petition on 23.10.2019 and a case in Crime No.202 of 2019 was registered under Sections 504, 506 and 447 read with 34 IPC, and took up the investigation. In the said instructions, it is stated that during the course of investigation, the third respondent examined and recorded the statement of the complainant, secured the scene in the presence of two independent mediators apart from drawing a rough sketch of the scene which is incorporated in CDF. Subsequent thereto, on 24.10.2019, the third respondent visited the scene, examined and recorded the statements of the witnesses and also collected the certificates of family members, residence, caste and local candidate and various other documents.

It is further stated in the written instructions that on the basis of the investigation, material evidence, which was collected during such investigation, and as per the statements of witnesses, the third respondent arrived at a conclusion that the petitioner's complaint and the allegations made therein are false. In view of the same, the third respondent sought permission from the higher authorities to refer the

case as 'false'. The Assistant Commissioner of Police, Siddipet, vide reference No.734/ACP-SPT/2019, dated 26.102019, accorded permission to refer the case as 'false'. It is also stated that after serving a notice upon the petitioner as regards the closure of the case as 'false', a final report would be filed before the concerned Court.

In view of the above, as the respondent authorities, after a detailed enquiry into the matter, have come to the conclusion that the complaint of the petitioner is false, no orders are required to be passed in this writ petition.

The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ____________________ JUSTI CE T.VI NOD KUMAR Date:31.10.2019 GJ
