Heard Sri A.K.Jayaprakash Rao for petitioner, Sri T.S.V.Prasad Naik for respondents 1 and 2 and Sri Jogram Tejavath for respondents 3 and 4.
The petitioner prays for the following relief :- " ...... issue an appropriate writ, order or direction particularly one in the nature of Writ of Mandamus, declaring that the action of 4th respondent in refusing to pay monthly membership pension by proceedings No SRO/ Cdp/ AP/ 295/ 107131/ Pen-1-2/ 08/ 2084, dated 30-9-2008 as illegal, unjust contrary to law, arbitrary, in violation of principles of natural justice and violative of Articles 14,16 and 21 of the constitution of India and grant all consequential benefits...." At the time of hearing, the Counsel representing respondents 3 and 4, by referring to following written instructions, dated 31.07.2017, " It is to inform that in W.P.No.26339/ 07 filed by Sri S.M.Peera, Employee of APSRTC (AP/ 295/ 107131) wherein the Hon'ble High Court has disposed of the case (order copy enclosed) with the direction to settle the claim in Form 10 D as and when received.
The Claim I Form 10D was received on 04.07.2017 and it was processed on the same day and transferred it to Regional Office, Kadapa, Andhra Pradesh, for processing of Pension. The claim is under process at Regional Office, Kadapa.
You are requested to present the same before the Hon'ble High Court."
states that final decision in this behalf would be taken expeditiously.
Sri A.K.Jaya Prakash Rao, having regard to the progress made on the pension papers of petitioner, requests the Court to stipulate the time limit within which the process already initiated is completed. The statements of learned counsel are placed on record. Respondents 1 to 4 are directed to pass final orders and disburse pension, in accordance with law, within four weeks from the date of receipt of a copy of this order.
