THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9198 of 2017 ORDER:
Though this Writ Petition was filed seeking consideration of representation of the petitioner dated 31.12.2016 addressed to the second respondent for transfer of investigation of Crime No.376 of 2016 from the fourth respondent to some other Investigating Officer, the grievance of the petitioner appears to be that the fourth respondent is not properly investigating Crime No.376 of 2016. The crime was registered on 02.12.2016 by the fourth respondent under Sections 447, 448, 463 etc., of IPC against 15 accused. The crime was registered on the basis of the complaint referred by the competent Magistrate.
In the circumstances, it is needless to observe that the fourth respondent shall continue the investigation of the crime in an impartial manner by following due process of law. If the petitioner has any grievance with regard to the investigation conducted by the fourth respondent, he can bring it to the notice of the third respondent, who shall act on the complaint of the petitioner by calling for the records from the fourth respondent and take necessary action.
The Writ Petition is, accordingly, disposed of.
