HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6469 of 2019 ORDER :

Petitioner, who is A1 in Cr.No.302 of 2019 on the file of the S.H.O. Women Police Station, Saroornagar, Ranga Reddy District, registered for the offences punishable under Sections 498-A, 323, 406, 420 and 506 IPC and 3 and 4 of DP Act, filed this petition under Section 438 Cr.P.C. seeking anticipatory bail.

Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent State.

Learned counsel for the petitioner submits that the petitioner never taken any dowry at the time of marriage nor demanded any additional dowry as alleged by the de facto complainant. The petitioner is self sufficient having a good job and also earnings. He further submits that the petitioner has got issued a legal notice in the month of June, 2019 to the de facto complainant calling her not to threat him and his parents and not to cause any mental agony to him and his family members. The de facto complainant in stead of changing her attitude and without giving reply to the legal notice issued by the petitioner, filed the present case with false allegations. Hence, he prays to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor representing the State vehemently opposed the bail application.

As seen from the contents of the FIR, there are specific allegations against the petitioner that the petitioner harassed the de facto complainant both physically and mentally for additional dowry during her stay in her in-laws house.

6. Taking into consideration the nature of allegations leveled against the petitioner and in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, the Criminal Petition is dismissed. However, the petitioner shall surrender before the concerned Court within 15 days and move bail application and the same may be considered in accordance with law. ________________________ JUSTICE G. SRI DEVI DATED: 23.10.2019.
