THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos. 6271 of 2022 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A3 seeking bail in the event of his arrest in connection with Crime No.214/2022 on the file of Manuguru Police Station, B.Kothagudem District, registered for the offences punishable under Sections 294(b), 307, 323, 448, 506 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that on 21.06.2022, Accused Nos.1 and 2 started blowing horn in-front of the house of defacto complainant. When the defacto complainant and her husband questioned the accused 1 to 3, they get down from the car and entered into the defacto complainant's house. An altercation took place between Accused Nos.1 and 2 and the husband of the defacto complainant. Thereafter Accused Nos.1 and 2 went out of the house and sat in their car and started the car. Then the husband of the defacto complainant's husband went to the car to know the reason for the quarrel. Accused Nos.1 and 2 threatened to kill
them and at that point of time the petitioner (A3) who was standing asked Accused No.1 to hit the husband of defacto complainant with the car because the vehicle was having insurance and will be covered. Thereafter, Accused Nos.1 and 2 went away in the said car.

As seen from the complaint, the allegation against this petitioner is that he was not in the car, however, he had asked Accused No.1 to hit the defacto complainant's husband with the car.

In the said circumstances, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner (A3) can be enlarged on bail in the event of his arrest, subject to the following conditions:
1) The petitioner/A3 is directed to surrender before the Station House Officer, Manuguru Police Station, B.Kothagudem District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A3 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties in a like sum each to his satisfaction.
2) On such release, the petitioner/A3 shall appear before the police on every Monday between 10.00 a.m. to 1.00 p.m. for a period of eight weeks, for the purpose of investigation.
3) The petitioner/A3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
