THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.6228 OF 2018 ORDER:

This criminal petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to fix an early date and dispose of S.C.No.79 of 2017 on the file of Special Sessions Judge for Fast Tracking the cases relating to atrocities against Women at Nizamabad District.

The main ground urged before this Court is that, there is a serious ground of paternity and the offences allegedly committed by the petitioner is punishable under Section 376, 417 & 420 IPC. As per the information received by this Court, no Officer is posted to preside over the above Court and a Family Judge Court is holding Full Additional Charge. Therefore, if, any direction is issued for disposal, it is a futile attempt.

However, the Family Judge who is placed in Full Additional Charge of the concerned Court, may decide the case at an early date, without disturbing the work in the regular Court. With the above observation, the criminal petition is dismissed.

Consequently, miscellaneous applications pending if any, shall stand closed. No costs.
