THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6272 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.257 of 2022 on the file of Abdullapurmet Police Station, Rachakonda, registered for the offences punishable under Sections 376(3) of Indian Penal Code and under Section 3 read with 4 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the petitioner had committed rape on victim girl aged around 15 years as per Ossification test. The said offence took place on 31.05.2022 and it is alleged that after forcibly participating in sexual intercourse, the petitioner started harassing the victim saying that he loves her and also he would like to marry her. Aggrieved by the same present complaint is filed.

Learned Assistant Public Prosecutor submits that investigation is complete and charge sheet is also filed. 5.

In the said circumstances, the petitioner can be granted bail subject to the following conditions:

i) The petitioner/Accused shall execute personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of XIV Additional Metropolitan Magistrate Court at Hayathnagar, Rangareddy District.

ii) The petitioner/Accused shall appear before the concerned Court on every date of hearing, without fail. iii) The petitioner/Accused shall not in any manner try to contact the victim or her family members and relatives. Failing which, the police are at liberty to file application for cancellation of bail iv) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
