HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.13468 OF 2017 ORDER:

The writ petition is filed challenging the action of the respondent authorities in directing the petitioner to stop the maintenance works of Gandhi Park, Ambedkar Chowrasta, Bodhan Town, Nizamabad District against to the condition/note of the agreement dated 19.06.2012 for extension of further period of five years.

Subject to condition petitioner paying the entire amounts of arrears due as on date and further continue to pay the monthly amounts payable to the respondent authorities on or before 10th of every month, the petitioner shall be allowed to continue the contract entered through the agreement dated 19.06.2012 till the expiry of the contract period. However, it is made clear that if any default is committed by the petitioner, the respondent authorities shall be at liberty to terminate the contract by issuing notice and to proceed further to fix up a new contract.

With the above observations, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition shall stand closed.
