HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.18520 of 2011 ORDER:
The jurisdiction of this Court, under Article 226 of the Constitution of India, was invoked questioning the inaction of the respondents in not taking action against the 4th respondent-fair price shop dealer, despite the petitioner having pointed out the irregularities committed by him, vide his representation dated 18.04.2011. In the counter-affidavit filed by the Tahsildar, it is stated that the action was taken against the 4th respondent, and he was imposed a fine of Rs.1,000/-.
Sri T. Nageswar Rao, Leaned Counsel for the petitioner would submit that, since action has been taken against the 4th respondent and punishment has been imposed on him, the cause in the Writ Petition does not survive necessitating any further adjudication by this Court, and the Writ Petition has become infructuous. The Writ Petition is accordingly dismissed. The miscellaneous petitions pending, if any, shall stand closed. No costs.
