HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.22613 OF 2019 ORDER:

The grievance of the petitioner in this Writ Petition is the inaction of the official respondents 1 to 5, more particularly respondent No.5, in not registering the FIR against the unofficial respondents 6 and 7 and their associates in pursuance of the petitioner's written complaint dated 23.09.2019, as being arbitrary and dereliction of duty. Heard the Learned Counsel for the petitioner and the Learned Assistant Government Pleader for Home. Learned Government Pleader for Home, on written instructions dated 21.10.2019, would submit that on receipt of the complaint, G.D. entry was made and enquiry was done and the enquiry revealed that the above issue is pertaining to the dispute for payment of rent between the owner and the tenant and that a Court case is pending in the Court.

Having regard to the same, the 5th respondent closed the petition as civil in nature and a notice was sent to the petitioner through registered post on 17.10.2019 informing him that the complaint given by him is closed as civil in nature.

petitioner is aggrieved by either the course of action adopted by the 5th respondent or the reason given therein, it is open for the petitioner to agitate the same before the appropriate forum in accordance with law.

Accordingly, this Writ Petition is closed. No order as to costs.

The miscellaneous petitions pending, if any, shall also stand dismissed.
