THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6281 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A3 in Crime No.76 of 2022 on the file of Kalapather Police Station, Charminar Division, Hyderabad, registered for the offences punishable under Sections 8(c) read with 20(b)(ii) (B) and (C), 21(b) and 27(a) of NDPS Act. 2.
Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The Kalapather police on information raided the premises of this petitioner/A3 and other petitioners also. As far as this petitioner is concerned, the police found 80 grams of Heroin and 3 Kgs. of Ganja.

Learned Counsel for the petitioner submits that the quantity seized from this petitioner is less than the commercial quantity. 5.
Learned Assistant Public Prosecutor does not dispute that the quantity of both 3 kgs of ganja and 80 grams of Heroin would be intermediary quantity.

In the said circumstances, the petitioner can be granted the relief of bail for the reason of the quantity seized being intermediary quantity.

Accordingly, the Criminal is allowed and the petitioner/A3 is granted bail subject to the following conditions: i) The petitioner/A3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Metropolitan Sessions Judge, Hyderabad.
ii) The petitioner/A3, after release shall appear before the concerned Station House Officer every day between 10.30 AM and 01.00 PM for one month thereafter as and when required, for the purpose of investigation.
iii) The petitioner/A3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
Miscellaneous applications, pending if any, shall stand closed.
