THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8129 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused seeking bail in connection with Crime No.132 of 2023 dated 14.07.2023 on the file of Gandhari Police Station, Kamareddy District registered for the offences punishable under Sections 324, 506, 290 read with Section 34 of Indian Penal Code (for short "IPC").

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The complaint made by the de facto complainant is that the buffaloes of these petitioners were grazing in the land of de facto complainant. The petitioners were questioned as to how their buffaloes were left in the fields of the de facto complainant, for which reason there was an altercation and fight ensued in between both groups.

One of the petitioners filed a complaint before the Gandhari Police Station, which was registered vide Crime No.131 of 2023. The de facto complainant filed the present case against these petitioners which was registered vide Crime No.132 of 2023 on the file of same police station.

Since there are no grievous injuries received by the de facto complainant or other members, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioners/Accused is directed to surrender before the Station House Officer, Gandhari Police Station, Kamareddy District on 31.08.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused shall appear before the concerned police as and when required for the purpose of investigation.

3) The petitioners/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
